We, Africa Dynamic Development Group (Pty) Ltd (“ADG”, “we”, “us”, or “our”), are committed to protecting your personal information and respecting your right to privacy. This Privacy Policy governs the way we collect, use, disclose, and store your Personal Information.

This policy should be read together with our Terms and Conditions, available on our website. By using our website, e-learning platform, or engaging with our services, you consent to the collection, use, and processing of your Personal Information as described in this policy.

Our processing of Personal Information is governed by the South African Protection of Personal Information Act 4 of 2013 (“POPIA”).

In this policy, unless the context otherwise requires:

  • “Personal Information” means information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person. This includes, but is not limited to, your name, contact details, ID number, photographs, and information collected during training and assessments.
  • “POPIA” means the Protection of Personal Information Act 4 of 2013.
  • “Data Subject” means the person to whom the Personal Information relates.
  • “Information Officer” means the responsible person within ADG tasked with ensuring our compliance with POPIA. Our Information Officer is our Managing Director, Frans de Beer.

3. The Information We Collect

We collect Personal Information to provide you with our training and e-learning services. The type of information we collect depends on how you interact with us.

3.1. Information from our E-Learning Platform and Website
When you register on our e-learning platform or visit our website, we may collect:

  • Account Information: Your name, email address, phone number, and password.
  • Profile Information: Your company name, job title, and country.
  • Technical Information: Your IP address, browser type, operating system, and details of your visits to our platform, including traffic data and resources accessed.
  • Communication Records: Correspondence between you and our team.

3.2. Information from In-Person Training and Assessments
As a registered training provider, we are required to collect specific information to ensure learner integrity and comply with regulatory bodies like the QCTO (Quality Council for Trades and Occupations). This includes:

  • Identification Documents: Copies of your South African ID book/card or passport to verify your identity for assessment and certification purposes.
  • Photographs: We may take photographs of you during training sessions for attendance records and verification purposes.
  • Attendance Registers: Records of your presence at scheduled training sessions.
  • Portfolio of Evidence (PoE): All required information and documentation as stipulated by the QCTO for the specific learning program you are enrolled in. This may include assignments, assessments, and other demonstrable proof of competence.
  • Inadvertent Collection: During audits conducted at our clients’ premises, we may inadvertently collect Personal Information. We take reasonable steps to only collect information directly relevant to the audit.

3.3. Information from Third-Party Platforms
We use social media platforms like LinkedIn and Facebook to promote our services. If you interact with us on these platforms, we may collect information you make publicly available on your profile.

4. Lawful Basis for Processing Your Information (in terms of POPIA)

We will only process your Personal Information if we have a lawful basis to do so. Our lawful bases include:

  • Consent: You provide clear, informed consent for us to process your information for a specific purpose, such as registering for our e-learning platform.
  • Legal Obligation: We are required by law (e.g., QCTO regulations, tax laws) to collect and retain certain information, such as your ID copies and Portfolio of Evidence.
  • Legitimate Interests: We may process your information where it is necessary for our legitimate interests, such as to ensure the security of our platform, to prevent fraud, or to analyze data to improve our training services, provided these interests are not overridden by your rights.

5. How We Use Your Information

We use the Personal Information we collect to:

  • Administer and deliver our training courses and e-learning content.
  • Assess your progress, verify your identity, and issue certificates or qualifications.
  • Maintain accurate attendance registers and learner records.
  • Communicate with you about your courses, account, and any service-related notices.
  • Respond to your queries, requests, and provide customer support.
  • Comply with our legal and regulatory obligations (e.g., reporting to the QCTO).
  • Analyze data to improve and develop our services, platform, and curriculum.

6. Data Sharing and Third Parties

We do not sell your Personal Information. We only share your information with third parties in the following circumstances:

  • Web Hosting Provider: Our website and e-learning platform are hosted by a third-party provider located in South Africa. This provider has access to the data necessary to provide us with hosting services and is contractually bound to protect it.
  • Social Media Platforms: Our website uses plugins from platforms like LinkedIn and Facebook. These platforms may collect cookies and data about your interaction with our site. Their use is governed by their own privacy policies, which you should review.
  • Legal Requirements: We may disclose your Personal Information if required to do so by law, court order, or a regulatory authority (e.g., the QCTO).

7. Data Security and Retention

7.1. Security
We implement appropriate technical and organizational security measures designed to protect your Personal Information against unauthorized access, alteration, or destruction. While we take reasonable steps to secure your information, no method of transmission over the internet is 100% secure.

7.2. Data Retention
We will only retain your Personal Information for as long as it is necessary for the purposes for which it was collected, or as required by law. Below is our standard data retention policy, which may be adjusted based on specific legal requirements.

We will securely destroy, delete, or anonymize Personal Information once it is no longer required.

8. Your Rights as a Data Subject

In terms of POPIA, you have the right to:

  • Access: Request a copy of the Personal Information we hold about you.
  • Correction: Request the correction of inaccurate or incomplete Personal Information.
  • Deletion: Request the deletion of your Personal Information, subject to our legal obligations to retain certain data.
  • Object: Object to the processing of your Personal Information.
  • Portability: Request the transfer of your Personal Information to a third party

To exercise these rights, please contact our Information Officer, Frans de Beer, at Frans.debeer@adss.co.za. We will verify your identity and respond to your request within 30 days. We will delete your Personal Information where we are not legally required to retain it.
